my guess would be: bad luck for you! if the company put a trademark on
the name then they got all the rights that belong to it. thats what
trademarks are made for, right? from all the cases that were in a
similar situation like you that i've heard of, the result was always to
choose a different name... 

why didn't you put a trademark on the name if you've been using it for
years? thats basically the first thing to do when starting a new company
or coming up with a new product.
