I did not mean to imply that this is a done deal.  While there appears to be
a "tentative" willingness at the FCC to sacrifice independent ISPs (who
operate at layers 2-5) at the altar of incenting broadband (layers 1 and 2)
deployment, they could be convinced otherwise.

Comments do matter.  ISPs need to organize and oppose.  Users must be
educated.  It is not over, but unless you do something, "you will be
assimilated."
